Family/Spousal support

Family support is when child and spousal support is combined into one figure.  This can have tax benefits.  More often, child and spousal support is calculated and ordered separately.  Child support is calculated by entering the gross incomes of the parents along with the percentage of time the child spends with each parent into an approved computer program.  The program then calculates what the base support shall be.  In addition, costs for medical care, school events and child care can also be included.  These are known as add-ons.  Temporary spousal support also uses the same computer program and is based upon the incomes of the parties.  Temporary support is designed to assist the transition to independent living and lasts until Judgment is entered in the case.   For those individuals that have had a long term marriage permanent support is ordered as part of the Judgment.  A long term marriage is one that has lasted at least 10 years.  Permanent support is designed to help maintain the lifestyle of the couple for the supported spouse.
